General conditions and cancellations, rules and restrictions, terms of use and cancellation policy

FLY GY LTD is essentially a travel agency and therefore acts as an intermediary between the traveler and the various service providers, such as: flight providers, hotels, shuttles, trips, tours, special packages and the like. The services offered by *FLY GY LTD * are carried out under the responsibility of the various service providers such as hotels, airlines, car rental companies, tour companies, shuttle services and more.


FLY GY LTD is not responsible in any way for any malfunctions, due to poor performance of the services related to the aforementioned service providers, or due to factors beyond the provider's control such as: strikes, weather, holidays, etc. An order made for one or more of the offered tourist services by FLY GY LTD constitutes the customer's agreement to all the terms and conditions detailed in this section relating to the various products.


Regulations, conditions and liability:

 

1. Registration and participation conditions

The mere registration of the traveler for the trip, or the provision of credit card details, or the sending of passport photos, or the mere participation of the traveler in the trip or part of it, express the full and explicit consent of the traveler to all the conditions detailed on this website, in the information pages and to the price distributed to all registrants. The updated and binding trip plan will be given to the traveler before he leaves for the trip subject to updates from time to time that will be sent to registrants.


2. The engagement agreement

The conditions that appear on the company's website and the updates that will be provided in writing to the passengers until the time of departure for the trip, constitute the contract between the company and the traveler.


3. Group size and composition

The existence of each cycle is conditional on the registration of at least 28 travelers in each cycle. The company reserves the right to cancel a trip cycle up to 15 days before its departure, if at least 28 travelers have not been registered by that date. The company will inform the registrant before charging the credit card the number of participants in the cycle he desires.


4. Health

You must contact the district health office at least two weeks before the trip to receive instructions regarding vaccinations and medications. The company is strictly prohibited from giving advice or instructions on these issues.


5. Smoking

No more smoking while traveling. Breaks will be given for appropriate periods of time for smokers.

Smoking in hotel rooms is prohibited. Smoking in a hotel room may result in fines according to the hotel's rules.


6. Passport and entry visas

You must have a passport valid for at least six months from the end of the month of travel. and make sure it has at least three blank pages. Issuing a passport and/or extending it is the sole responsibility of the traveler. In any case of cancellation of the trip or changes resulting from problems with the passports of the passenger or passengers, or changes in visa rules from the policies of the governments of the countries where we will travel, the company is not responsible for the damage and expenses involved.


7. Number of travel days

The number of days of the trip includes the day of departure from Israel and the day of return to Israel, even if there is no tour program on these days. If the number of days of the trip is changed, due to a change in the flight schedule and/or unexpected changes in the program, etc., the price of the trip will be updated according to the addition and/or reduction. It is hereby clarified that the change will not be relative to the number of travel days that were reduced or added, but rather according to the actual cost that was added to the company or reduced due to the change.


8. Flights

A change in the scheduled flight schedule made by the airline or a change in the airline may result in a change in the length of the trip and changes in the route. The price of the trip will be updated accordingly. Notification of a change in the flight schedule is possible at very short notice. A traveler who cancels his trip due to an immaterial change from the changes listed above will be charged a cancellation fee according to the conditions of the published prices.


9. Unusual flights and flight cancellation fees

Passengers who exceed the group flight limit on the return date or return destination, on the same airline, must pay the supplement. Details will be provided during registration, or on the day of the application, depending on each case.

Canceling a flight ticket before leaving for the trip will charge the passenger the amount of the cancellation fee for the entire package.

If the airline schedule changes, the route will be adjusted to the new schedule. If the change results in the addition or reduction of nights at the beginning or end of the trip, the price will be updated accordingly.


10. Change in prices

The total price of the trip (flights, ground services, tip, VAT, entry visas (if requested), port taxes, and security and fuel charges) is announced to all our customers in a special message by e-mail. The price of the flights is based on the rates and policies of the airlines, as of the day Publication of the trip In cases of imposition of new taxes or levies in Israel or abroad that did not exist when the plan was published - the company reserves the right to update the total price, with the amounts of the new taxes or levies that were imposed, and were not included in the price on the day the trip was published.

In case there is an increase in flight prices or a significant change in the exchange rates in the country of the trip compared to the dollar, the company reserves the right to update the price of the trip accordingly, even if partial or full payment was made by the traveler.


11. Security and fuel levies

Aviation authorities in Israel and abroad have announced various security levies and surcharges due to the increase in fuel prices on the flight ticket. These amounts are not included in the price of the trip, and will be charged in accordance with the guidelines of the airlines. The final price of taxes and charges is updated when the flight tickets are actually issued (up to a few days before the departure of the trip).


12. Entering and leaving hotel rooms

In the case of flights arriving at the destination early in the morning or leaving late in the evening, the company will make an effort to get early entry to the rooms (at least some of them) or late evacuation of the rooms (at least some of them) by a few hours. In any case, the company does not undertake to provide the rooms immediately upon arrival or to allow a late stay in the rooms until the flight time.


15. Terms of payment

At the time of final registration for the trip, the registrant will provide the credit card details to the company.

Those paying for each trip will be given the option to pay in three equal payments without interest as long as the three payments are paid up to 60 days before the trip departure date.

The payment will be made in shekels according to the exchange rate of the dollar or the euro (depending on the price of the package), selling transfers and checks of Bank Leumi on the day of payment. More details will be provided in the regular updates sent to our customers.


16. Cancellation fees

The traveler must purchase health and luggage insurance, including insurance against corona, suitable for his health condition and age, which covers the passenger for the cancellation of the package for medical reasons, in order to avoid paying cancellation fees.

Below are the fixed cancellation fees* for our tours:

Cancellation up to 60 working days before the trip departure date, 50% of the trip price.

Cancellation between 60 days before departure and 31 days before departure: 75% of the trip price.

Cancellation between 31 days before departure and until departure: 100% of the trip price.

* The components of booking the organized tours, with the exception of the flight in some cases, are ordered from foreign parties as explained in Amendment 58 to the Tourism Law. In addition - the cancellation fees are subject to all the cancellation conditions that will be applied by the suppliers abroad, if they differ from those detailed above.

The financial refunds that will be received from the foreign suppliers in accordance with the cancellation policy of the suppliers, resulting from the cancellation of a trip, will be made within 30 days from the date of receipt of written notification of the cancellation by the customer.

Clarification regarding the date of cancellation by the traveler: Notice of cancellation can be given to our office in writing by email.

We recommend once again to purchase insurance already at the time of registration, which will allow coverage for the cancellation of the trip for medical reasons according to the rules of the policy. Restrictions on cancellation of a transaction: It is not possible to cancel a transaction if the cancellation notice was given within 30 working days until the date of the trip.


17. Emergency situations

We will be entitled to announce the cancellation of a trip, in whole or in part, even with very short notice, if, according to our sole and absolute discretion, it cannot be carried out or there is an obstacle or danger in carrying it out, in circumstances beyond our control, including due to strikes, warnings, instructions from authorized authorities, Epidemics, natural disasters, war and emergency situations, etc. In any case as mentioned, we will not be responsible for any damage, direct or indirect, or for any inconvenience due to the full or partial cancellation. In the case of a full cancellation as mentioned, the money paid to the company will be returned to the traveler, in shekels, offsetting any expenses incurred by the company (including an obligation of the company) and for which it was not reimbursed. In any case where a traveler decides to cancel his departure for the trip, including for the above reasons, the provisions detailed in the price list regarding the possibility of cancellation will apply to him.


18. Warranty and insurance

The company will not be responsible for any damage, direct or indirect, to the body or property, caused to the traveler during the trip or due to its cancellation or changes in it, for any reason whatsoever, including due to accident, theft, loss of luggage or documents or expenses that the traveler had to spend for them. If the company incurred any expense for the traveler, the traveler must return it in full to the company. The traveler undertakes to purchase for himself and for himself full and appropriate insurance for the body and property, with no right of substitution against the company or anyone on its behalf.


19. Disagreements

The local jurisdiction will be the courts of the city of Tel Aviv only. The company may, at its sole choice and at its sole and absolute discretion, demand from the traveler that differences of opinion between him and the company be clarified before an arbitrator or arbitrators to be appointed with the consent of both parties.


20. Refusal to register and/or trip cancellation

The company reserves the right to reject a request for registration and/or to refuse to participate with any person who, in its opinion, may interfere with the proper course of the trip without any need to justify its position on the matter. The company reserves the right to terminate the participation of a traveler whose behavior and/or state of health prevents his continued participation in the trip and/or harms or may harm the traveler himself, the guide or other participants, all at the sole and absolute discretion of the tour guide. In the event of termination of participation as mentioned, the funds collected for the trip will not be returned to the traveler unless the company receives a refund for the proportional portion that was not used.


21. Liability

The ground and flight services are not provided by us, and naturally they are purchased for the travelers from external parties such as airlines, hotels, training companies, etc. In everything related to them, we are only an intermediary between the suppliers and the traveler, and therefore we are not responsible in any way for disruptions, malfunctions or changes that will apply to them.
